Premises Liability

Premises liability is the body of law which holds owners and occupiers of property responsible for certain accidents and injuries suffered by persons who are on the premises property.  Many different kinds of accidents can give rise to premises liability claims, whether a person slips and falls on a sidewalk or suffers an injury on an amusement park ride.  Within the context of premises liability, a person “possesses” land or premises when:

  • The person is in occupation of the land with intent to control it.
  • The person has been in occupation of land with intent to control it, if no other person has subsequently occupied it with intent to control it.
  • The person is entitled to immediate occupation of the land, if no other person is in possession as just defined. 

In some states, the landowner's duty to protect an entrant on the land depends on whether that person is a trespasser (someone who enters without any right to do so), a licensee (someone who enters the property for his own purpose or as a guest of the owner), or an invitee (someone who was invited on the property). The landowner's duties are different for each type of entrant. The landowner owes less of a duty to protect the trespasser than the other types of entrants. The landowner's duty of care is highest for business invitees. Some states, however, have done away with these multiple classifications in favor of one standard of "reasonableness under the circumstances" of a particular case.
