New Orleans Ends Slip and Fall Case

A long court case in New Orleans has finally come to an end this week at the hands of Orleans Parish Civil District Chief Judge Lloyd Medley. The five-year-old slip and fall case was closed after the city of New Orleans pushed for a motion for summary judgment. It originated with the complaint of resident Merkel Marshall who claimed that a crack in the Palmetto Bridge caused him to fall and hit his head. The cause was negligence on the part of the city to maintain the bridge properly.

The original petition for damages was filed in November 2005 by River Ridge attorney Jeanne Demarest; Bart Kelly and Roderick Alvendia would later come on to represent Marshall as well.

In 2008 the city filed a motion for summary stating that it "did not have notice, either constructive or actual, of the alleged defective steps at the Palmetto Footbridge" before the accident occurred, thus making it protected by La. R.S. 9:2800.

When the city attempted to continue the case, the plaintiff, Marshall, had to be located by the city through an investigation service.
