Woman Wins Slip and Fall Claim against School District

In Shell Lake, a woman recently won a slip and fall lawsuit filed against the Spooner Area School District.  The jury determined that the defendants were negligent on August 26th.

According to news reports, on January 19, 2009, Carmen L. Taylor was at the Spooner Elementary School for a game.  She left around 6:00 PM and slipped approximately 10 feet after leaving the building on a sidewalk that had a slight incline.  This caused her to suffer serious injuries.  Taylor testified that she did not see ice on the sidewalk because snow had blown over it.

The school's building manager testified that the night of the game, there was freezing rain which created glare ice.

Taylor filed her claim against the school district and said that her slip and fall caused her to suffer permanent injuries, which were subject to a final medical opinion.  Her lawyer said the school was in violation of the Safe Place statue.

In September 2009, the district's insurance company responded to the claim with a denial of an act or failure that cause Taylor's injuries, as well as a denial of negligence.  However, the jury found that the district was negligent and issued orders for the district to pay approximately $67,000 in damages.
