Widow Files Lawsuit for Husband's Train Accident Death

After losing her husband due to a train accident, a widow has decided to file a wrongful death lawsuit.

On October 9, 2010, the widow's 32-year-old husband was seen walking along the tracks by the train's crossing. Although the train did sound its horn several times, it was unable to stop in time to avoid hitting the victim. Following the collision, the victim was transported to a local hospital where he succumbed to his massive injuries a few hours later.

Even though the conductor did attempt to warn the victim, the widow is suing the railway company for killing her husband. The widow is arguing that her husband was attempting to cross the tracks using a pathway when he slipped and fell. Since he slipped on their crossing, the woman alleges that the train company is responsible for his death. She also says the company is responsible because the conductor did not stop in time and her legal counsel asserts that the train was going faster than the allowed limit of 30 MPH.
