Judge Makes Ruling in Train Accident Case
A Los Angeles County Superior Court Judge who is overhearing the lawsuit regarding the train accident of September 12, 2008 made his final decision. The commuter train crash took the lives of 122 people whose families are now asking for a piece of the settlement.
After hearing from all the involved parties as well as legal defense for both sides, the judge released his 45-page decision. In the lengthy document the judge explains why he decided on an average of $4.2 million per family affected by the crash, as well as $12,000 to one of the two victims that was not physically but emotionally scarred by the accident.
A foreign exchange student was awarded the highest amount at $9 million. Not only did she suffer the most bodily damages, but her medical bills were the highest. As a result of her injuries - third degree burns, a fractured skull, and having a portion of her brain removed – the victim will continue to need medical assistance for years to come. For families that lost a child, it was ordered that they will receive an average of $1.2 million payable over the next few years.
