100 Injured durign Train Accident
Although more than 100 hundred were injured when a passenger train slammed head-on into a freight train 2.5 years ago, just two of these testimonies were graphic enough for the courtroom last week.
Richard Myles, one of the more seriously injured passengers, spoke with the judge about his broken neck, damaged spine and his career path that had also been derailed as a result of the accident. His lawyer, R. Edward Pfeister Jr., is asking for $10 to $12 million of the total $200 million settlement allotted for this case. Along with Myles there are 25 more families and 100 injured passengers who are hoping for a piece of the pot.
However, despite all the testimonies Superior Court Judge Peter Lichtman told attorneys that there is a federally mandated cap on settlements and they should be mindful when making their pleas to the court. Lichtman also went on to say that he estimated at least two months time to hear all victim testimony and divide the money accordingly.
The terrible train accident happened on Sept. 12, 2008 when the passenger train went through a red signal.
