  Nursing Home Sued for Negligence and Wrongful Death

Another nursing home is at the center of a lawsuit for the death of a patient housed there. Carol Kiefer, the executor of the estate of Doris. I. Schaeperkoetter, has filed suit against the Lincoln Home Inc. as well as its owner, Weiss Management Group LLC. The two doctors in charge of the nursing home, Drs Mahrukh and Jawad Ali Khan are named as the respondents in discovery.

The petition, filed in St. Clair County Circuit Court, shows that Schaeperkotter was living at the home from July 2008 to January 2010. Her executor alleges that the she was not given the proper level of care required to keep her healthy and alive. In fact, their negligence is the supposed reason of her death in January 2010 when she suffered sepsis, dehydration and hypoxia.

The Lincoln Home Inc. has been charged with nursing home negligence leading to wrongful death in the case of Schaeperkotter. Kiefer is asking for over $200,000 in damages for medical expenses as well as court costs.

  Two Men Fall 60 Feet during Construction Accident

Two men fell sixty feet to their death on the Upper West Side as a result of a construction accident.

The two men were ironworkers while on the site of a building that is being redeveloped for a church. According to an anonymous law enforcement official the beam that the men were standing on gave way on the seventh floor. Although fire personnel rushed to the scene and administered CPR to one of the victims, their efforts were lost on the two men who were later pronounced dead. The men were taken to two separate hospitals.

The site contractor, the F.J. Sciame Construction Company, has publicly confirmed the deaths of the two men. Although their identities are not being released until their next of kin have been notified, it is known that they were aged 49 and 51.

This accident happened at 150 West 83rd Street, near Amsterdam Avenue. The building is being constructed for the Redeemer Presbyterian church.

  Jeffrey Knight Says He is Guilty for Drunk Driving Accident

Jeffrey Knight pleaded not guilty to the drunk driving accident in which a mother and child were killed.

Knight has been charged with vehicular manslaughter in the death of Brittany Thomas, 21, and Aiden, her ten-month-old son. A member of the Alcoa police department testified that his blood-alcohol level was 2.5 times the legal limit. After interviewing Knight police discovered that he had played a drinking game right before driving to work where you take five shots of alcohol in five minutes.

Knight's trial has been set for December 13th.

  3 Bus Accidents Occur in Hillsborough County

In Hillsborough County alone three bus crashes were recorded.

The first crash occurred around 7:13 a.m. as a school bus on the way to Dowdell Middle crashed at Palm Avenue and 50th Street. According to sheriff's spokeswoman Debbie Carter, there were 23 students on the bus at the time, five of whom complained of back and neck soreness. They were treated at local hospitals for their injuries. Police found that a van had driven into the side of the bus' path, and while the driver did not receive any injuries, he was given a citation for careless driving.

Another crash involved two buses later on in the day, when a school bus and a HART bus hit on Kelly Road at Memorial Highway. Many people on the HART bus 2415 complained of injuries; luckily there were no students on the school bus.

The final accident of the day happened at Palm and Larner avenues in Tampa. Police stated that there were no students on the bus at that time and the driver was not injured.

  Parents Sue Skydiving Company for Wrongful Death

The parents of a woman who died in a skydiving accident are now suing the company for her wrongful death. Jennifer McCoun, the former CEO of the Tulare Chamber of Commerce, died in 2009 at the hands of Adventure Center Skydiving, Inc. according to James and Marilyn McCoun.

According to their lawsuit the company is responsible for fraud, negligent misrepresentation, alleged wrongful death and negligent infliction of emotional distress. Their lawyers dug up two additional fatalities that occurred under the watchful eye of Adventure Center Skydiving that the company refuses to acknowledge. They also found reports of staff members drinking alcohol and smoking marijuana while checking the equipment. To add insult to injury the family claims that they were not informed of their daughter's accident until several hours after she had been taken to the hospital. They are asking for $25,000.

  Jury Awars $49 Million in Car Accident Case

A jury in Ventura County has given an award of over $49 million for a lawsuit involving a man that lost his life and a California Highway Patrol officer that is now a quadriplegic.

The lawsuit is against a truck driver that was found to be driving under the influence as well as transporting marijuana. In December of 2007 Officer Anthony Pedeferri had pulled over motorist Andres Parra on U.S. Highway 101 when the driver ran into both of them, killing Parra and injuring Pedeferri.

After hearing testimony for both sides the jury gave $39 million in damages to the Pedeferri family for his paralyzing damages, while $10.2 million was given to Parra's parents for losing their son.

The driver has been incarcerated since 2008 on a fifteen year sentence.

  Truck Transporting Pigs Involved in Collision

If you were driving down I-435 North to I-35 North in Kansas City, MO last week you might have seen fifty pigs running across the road. That is because a truck accident on Monday caused the driver to lose control, allowing up to fifty pigs to escape.

Luckily the driver was wearing a seat belt when he took the curve too fast and lost control of his vehicle. According to Highway Patrol Sgt. Rick Fletcher emergency crews attempted to round up the pigs but it wasn't an easy task as "they go every which way but the way we wanted them to go."

Although it isn't known what the final destination of the pigs was, if it was a slaughterhouse or not, but a few pigs did lose their lives in the wreck. None were injured running around in traffic, however.

  Olympic Swimmer Saves Life

Not only has he won an Olympic silver medal but now Terrence Parkin can add hero to his list of accolades. He was swimming at his local gym when he realized that a young boy had gotten stuck in one of the pool's vents.

By the time Parkin was able to free him the boy was believed to have been submerged for at least three minutes as he was completely unresponsive when removed from the pool. However, the South African Olympic swimmers quick actions are ultimately responsible for saving the boy's life.

According to Netcare 911 Parkin had already begun to give the boy CPR.

  Officer Caused Hit and Run Accident

An officer finds himself on the other side of the court room this year as he is charged with a misdemeanor hit-and-run crash in Torrance.

Richard William Hatten, 36, was represented by his attorney William Haddon last week who entered a not-guilty plea for his Manhattan Beach police officer client.

He has officially been charged with leaving the scene of the crime, along with two other passengers, where he struck another person. However, he is the only one being charged at this time. Officer Hatten was placed on administrative leave by Manhattan Police Chief Rod Uyeda as the department investigated the crash. The two other officers in the car, Eric Eccles and Kristopher Thompson, are not commenting on the case.

The officer on duty at that time, Jeff Goodrich, did not file a police report on the crash. He later succumbed to cancer.

  Family Sues for Tragic Nursing Home Abuse Related Death

Another horrible nursing home story surfaced in the news this week, this time surrounding a hospital in Illinois. The family of a former resident of the Maple Ridge Care Centre is suing over the alleged abuse that led to the premature death of the 63-year-old victim.

Their suit states that the nursing home abuse included the failure to properly take care of the patient, delaying action on symptoms that had arisen. It was 16 hours later when the medical problem was diagnosed; however, this delay led to the amputation of her left leg and then to a deep-vein thrombosis that killed her.

While this case is tragic it isn't the first time that Maple Ridge has had complaints filed against their facility. The state had already fined them for the death of a 32-year-old resident and spina bifida sufferer, earlier that year when staff members failed to revive her with a cardiopulmonary resuscitation.

  Police Report Truck and Minivan Collision

Tragedy struck in Minot when a 2010 Chevrolet pickup truck collided with a 2000 Pontiac minivan traveling westbound on U.S. Highway 2.

Investigators learned that the 30-year-old man driving the minivan turned in front of the pickup truck as it was attempting to drive on 62nd Street Northwest. The driver of the minivan was taken to Trinity Hospital and later pronounced dead. Matthew McDonald, 26, and passenger Joseph Sallgren II, 26, escaped injury in large part due to their seat belts.

  10 Car Pile Up Kills 3 People

A ten-car pileup in Los Angeles took the lives of three people and injured several more. The Pacific Coast Highway in Orange County was shut down for ten hours as a result of the massive accident that is believed to have been caused by a Ford Taurus driving too fast.

The driver of the vehicle, 27-year-old Julia Allen, was killed on the scene. Investigators determined that her Taurus went airborne, flying into the opposite lane and hitting a white Ford Taurus, a Toyota Prius and a Toyota Tacoma pickup. The other two victims of this accident were Linda Burnett, 69, and Christopher De La Cruz, 49.

There were three more people injured that evening, including a motorcycle rider who was last listed in critical condition. However, all three are expected to live.

  Police Believe Owner Trained Dog to Attack Woman

Police responding to a disturbance on December 23 soon learned that the man responsible had trained his dog to bite another woman. The 56-year-old man from Orland Park has been charged with misdemeanor domestic battery for training his canine to bite a 54-year-old woman.

The two had been arguing before police arrived at the home on the 1700 block of Brookshire Drive. They found the woman with red marks on her face and a bite mark on her leg. While most of the marks were caused by the man grabbing the woman, she repeatedly told police that he had trained his dog to react that way whenever they argue.

  Victim Gets $1.75 Million Award for Medical Malpractice Case

A former patient at Harbor-UCLA Medical Center was granted the $1.75 million in settlement money after an injury at the hospital left her seriously injured. This amount was approved by the Los Angeles County Board of Supervisors on Tuesday afternoon.

  Chain Reaction Collision Occurs in West L.A.

A chain-reaction crash that shut down a busy intersection in West Los Angeles left one motorist critically injured and a pedestrian dead.

A car traveling southbound on Federal collided with another auto going eastbound on Santa Monica, which caused the southbound car to spin out of control, striking a pedestrian. The car then continued on its crash course and hit another car at a gas station that was being refueled.

Seven emergency vehicles were called out to the scene to attend to the injured and close down the intersection. Traffic on surrounding streets was tied up until well in to the late afternoon.

The driver of that vehicle was taken to a local area hospital to be treated for serious injuries. Luckily the driver of the other vehicle sustained very minor injuries.

At this time police do not have a cause of the accident nor had they made any arrests in relation to the accident.

  Hit and Run Accident Takes Life of Famous Video Game Casting Director

A hit and run car accident took the life of Brigitte Burdine, a famous video game casting director, in Los Angeles last week.

At this time detectives are still working to track down the person(s) responsible for Burdine's death. Passersby reported seeing a dark colored sedan driving on Culver Boulevard near Pershing drive, however, nobody has been able to describe the driver nor could their sex be determined. 

Although she was quickly transferred to a nearby hospital by the Los Angeles Fire Department, Burdine later passed away.

Burdine was responsible for casting for World of Warcraft and Socom 3: U.S. Navy Seals.

  Ladder Falls in Way of Bus and Causes Accident

When a ladder fell in the way of a school bus in Lee County, the driver and another student were injured. The bus driver, Christine Bianco Lataille and a 6-year-old boy were treated at Lee Memorial Hospital; the two other students also riding on the bus were not injured.

According to the Florida Highway Patrol responding officers, a van that had a ladder attached to the roof was driving near Forest Park Drive when the ladder detached when the vehicle came to a stop. At that time the bus was traveling southbound on Hart when it hit the ladder. The driver, 68-year-old Lina McCall, has been cited for having an unsecured load.

  Goodyear Tire Loses Wrongful Death Case

Even though they had the U.S. Chamber of Commerce and several other pro-business groups to support them, Goodyear Tire and Rubber Company were unable to convince the Nevada Supreme Court that they deserved another chance. Their request for another hearing was denied when the Court found that the company's attorneys had engaged in stall tactics and acted in bad faith.

This all revolves around a $30 millionwrongful death lawsuit against the tire giant for the rollover death of three people in August 2004; one more person was also injured in this accident.

According to court documents, a Goodyear tire failed, leading to the crash. However, these facts were never presented to a jury; only damages were left to the jury to decide in this case. Instead, former District Judge Sally Loehrer decided to sanction Goodyear by taking away its answer to the lawsuit.

Goodyear is now fighting back, its lawyers saying that Loehrer should have held an evidentiary hearing to determine how much damage the delays caused and how severe they were.

  16 Year Old Loses Life in Single Vehicle Crash

Ashley Victoria Prado-Zamorano, 16, lost her life in a single-vehicle crash that left six others injured as well in Willows.

She was riding in a passenger van driven by Erika Diaz, 33, when the driver lost control and caused the van to flip. Of the seven passengers, Prado-Zamorano was the only one not wearing a seat belt. Several passersby called 911 to report the accident including a man who identified himself as an Army Medic. He told emergency personnel that one girl was definitely deceased while others appeared to be seriously injured.

California Highway Patrol has since released the names of the other passengers and their condition. John Morfin, 39, and Joaly Morfin-Diaz, 11, suffered major injuries and were taken to the Enloe Medical Center and UC Davis Medical Center. Younger passengers Joanna Morfin, 9, and Gabrielle Prado, 13, suffered minor injuries. There was only one passenger who escaped injury entirely, 15-year-old Joscelyn Morfin.

  Train Accident Leads to Unfortunate Death

Deputy Tony Miller was on the scene immediately when a man walked onto the train tracks near Los Angeles and died last week. Although Miller has been patrolling the busy tracks for less than a week, he was sad to have to inform a family about the death of their loved one so soon.

When Miller discovered the man on the tracks the victim's back was to the train car and he was wearing headphones. They were still blaring music.

While this was his first death on the tracks he has come to discover that there are many accidents that occur along the 22-mile Blue Line. Since it opened in 1990 the track has hosted 101 fatalities, 23 of which were suicides, and 875 collisions with autos and pedestrians. These often occur in the poorer neighborhoods that cross the tracks.

The numbers of train accidents on the Blue Line are among the highest for the Metropolitan Transportation Authority which operates five lines.

  Houston Space Center in Middle of Slip and Fall Claim

The Houston Space Center finds itself in the middle of a slip and fall lawsuit this month. The plaintiff, Senny Oommen, claims that he slipped and fell on a wet floor when visiting the museum. The lawsuit was filed in the Harris County District Court on December 17 by attorneys L. Lee Thweatt of Terry and Thweatt P.C.

The accident occurred on December 20, 2008 when Oommen claims that there was a wet spot on the floor near the area where you can take souvenir photos that the museum was negligent in cleaning up. As a result he fractured his tibia and wound up losing his job as a result of being unable to perform his duties there.

He is now seeking damages that include mental anguish and physical pain, physical disfigurement, physical impairment, loss of earning capacity, medical expenses, and other damages.

  Two People Killed during Auto Accident in Palmdale

Tragedy struck in Palmdale on Sunday evening when two people lost their lives in a car accident.

California Highway Patrol officer Patrick Kimball announced that the two cars involved in the accident - a Mercedes-Benz and a sports utility vehicle crashed on Pearblossom Highway at Sierra Highway.

Three other people were involved in the accident, including a child, were injured; two of them were deemed to be in critical condition at Antelope Valley Hospital.

At this time police are not revealing any additional details regarding this fatal car accident as their investigation continues.

  Drunk Driver's Vehicle Lands Between Two Homes

An odd car accident occurred in the 1400 block of West 17th Street in San Pedro last, awakening residents at 1:05 in the morning. The Black Fusion, reportedly driven by a drunk driver, went airborne and became wedged between two homes, eight feet off the ground. Significant damages were sustained by one of the homes; luckily, nobody was present at the time as it had just sold a few days ago.

Residents of the second home woke up after hearing the crash. Luckily, nobody in that home was hurt. The front of the car wound up in the kitchen of one home while the rear became lodged in the living room of the other. Rescue crews and officers using two heavy-duty tow trucks worked for over four hours to remove the vehicle.

Police were not able to determine the speed at which the driver was traveling at the time. There was a passenger in the car that fled the scene while obtaining medical treatment; however, the passenger returned later on. Police did not arrest him.

Reports show that both the passenger and driver were under the age of 21.

  Dog Bites Resulting in Hospital Visits Increases

A new report from the Agency for Healthcare Research reveals that the number of dog bites that result in a human's hospital visit has increased over the past few years. In 1993 the number of dog bite victims was 5,100; in 2008, the number was 9,500 according to Booster Shots, the health blog of The Times.

In 2008 alone 316,000 emergency room visits were a result of dog bites, which amounts to an average of 866 dog bitten-Americans per day, 26 of which will need to be hospitalized. The change of a dog bite quadruples for dog bites in rural areas versus urban areas, and triples if you live in a rural area.

  Truck Transporting Christmas Trees Involved in Collison

A truck accident on a freeway exchange in Los Angeles caused rushed-hour nightmare last week when a tractor trailer carrying 42,000 pounds of Christmas trees overturned on the highway. California Highway Patrol came and shut down the highway where crews worked for the next few hours to clear the scene.

One of the responding officers, Miguel Luevano, replied that "luckily the trees didn't spill out of the container, but it's a tight curve in there at that interchange...so it's taking a while to right that trailer on back on its wheels." The accident caused a ripple effect of gridlock onto other freeways and streets.

Although the driver was taken to the hospital he was only treated for bruises and cuts, as well as a laceration to his ear. At this time officers believe that the accident was a result of speed, where the driver took the turn too quickly.
