| Truck Transporting Christmas Trees Involved in Collison |
| Posted By Law Offices of Gerald L. Marcus |
 |
A truck accident on a freeway exchange in Los Angeles caused rushed-hour nightmare last week when a tractor trailer carrying 42,000 pounds of Christmas trees overturned on the highway. California Highway Patrol came and shut down the highway where crews worked for the next few hours to clear the scene.
One of the responding officers, Miguel Luevano, replied that "luckily the trees didn't spill out of the container, but it's a tight curve in there at that interchange...so it's taking a while to right that trailer on back on its wheels." The accident caused a ripple effect of gridlock onto other freeways and streets.
Although the driver was taken to the hospital he was only treated for bruises and cuts, as well as a laceration to his ear. At this time officers believe that the accident was a result of speed, where the driver took the turn too quickly.

A man was killed on the job this week just outside of Salinas, CA when he and another worker were hit by a truck. Alredo Gonzales Raya, 46 years old, was working in a lettuce field when a truck backing up hit him and another man, despite the fact that both were wearing bright yellow reflective vests. The second man was hurt and hospitalized with no life-threatening injuries.
California Highway Patrol Sergeant Ray Faulk affirmed that, after hours spent by investigators in the field, a truck delivering cardboard to other parts of the field did in fact back up and hit the two man by accident. Fellow coworkers rue the passing of Raya and will miss him. Don't let medical bills pile up when someone else is responsible for causing them.

| Three Vehicle Accident Causes Road Delays |
| Posted By Law Offices of Gerald L. Marcus |
 |
A truck accident in Pasadena involving a car, a big rig, and a pickup truck caused both traffic and Metro delays when two of the vehicles became entangled and wound up on the tracks.
Reports say that the accident occurred when a car made an unsafe lane-change on the eastbound 210 freeway, cutting off the big rig. Both vehicles lost control, resulting in the big-rig swerving into a pickup truck and pushing the pick-up truck onto the Metro tracks.
The driver and passengers in the pick-up truck and big-rig were transported to Huntington Memorial hospital for review, although no one seemed to be seriously hurt.
The truck accident also resulted in delays for both the Metro service and freeway. It took several hours to clear the roads and rails, causing rail service to be delayed by over twenty minutes and backing up traffic on the 210 freeway for an hour.

|
Police say that one man is dead following a Monday morning trucking accident outside of Fayette County. At approximately 9:00 AM, a call was received by the Fayette County EOC reporting that a single vehicle accident took place in an area that is known as "dead man's curve".
At the scene of the accident, police pronounced 45 year old Marshall Spinks Jr. dead.
Officers say that they are reconstructing the scene of the accident to determine what speed the truck was traveling. It is believed that the victim turned into the sharp curve and suddenly lost control of his vehicle. The vehicle ran off the side of the road and then plummeted down a 40 foot embankment. Officers also state that the truck appeared to have flipped and was severely damaged.
Police plan to continue investigations, which will last several weeks and say that they hope to gather further insight into what may have caused the accident. Spinks was not wearing a seatbelt when the crash occurred.

| Posted By Law Offices of Gerald L. Marcus |
 |
In Santa Barbara, it is reported that on August 24th a fully loaded gravel truck veered off a highway on Tuesday and crashed into a house, killing a man, woman and a child. The Los Angeles Times reported that the identities of the people killed were not immediately identified and that response crews were searching the house for a possible fourth victim.
According to police, the driver of a double tractor-trailer truck was traveling south on Hwy. 154 when he crashed into four other vehicles and then traveled down the driveway directly into the house. Police say that the house was completely destroyed upon impact and that they found a man and a woman dead at the scene of the accident. After an hour of searching the scene, they found a child's body.
Police used dogs to search the house for a fourth person who they believe may have been inside although neighbors say they saw that person leave on a bicycle prior to the collision.
The driver of the truck was treated at the scene of the accident for minor injuries.

| Minnesota Wrongful Death Settles |
| Posted By Law Offices of Gerald L. Marcus |
 |
In the state of Minnesota, a Duluth trucking company that is no longer in business has finally settled a wrongful death claim.
This week, a settlement was reached between Monson Trucking and the family of Wayne Swenson. Back in 2007, Wayne died on Interstate 35 near Proctor when a truck from the company suddenly stopped in front of him.
An attorney representing Swenson's widow claimed that the truck driver had not been trained on how to deal with an overheated vehicle. Swenson allegedly slammed on his brakes in an attempt to avoid the truck, but a car struck his motorcycle and pushed him directly into the truck.
Both parties agreed to settle the wrongful death claim for an undisclosed amount of money prior to a pretrial hearing.

| Pickup Truck Accident Kills Local Woman |
| Posted By Law Offices of Gerald L. Marcus |

Authorities say that a 31 year old woman from Modesto was hit and killed after she crossed paths with a pickup truck in Turlock. April J. Chaves was hit by the truck, which was traveling north on South Central Avenue, said the California Highway Patrol.
The CHP identified the driver of the truck as 51 year old Jose Garcia. Police say that as Garcia approached the 6000 block of South Central, he neared a car parked on the west side of the street that had its lights on. As Garcia passed the car, Chaves crossed the street and was hit by his truck.
Police say that Garcia did not realize that he had hit Chaves and continued to travel north. A witness tracked Garcia down later and he then returned to the scene of the truck accident.
Authorities arrived at the scene and pronounced Chaves dead at 9:27 PM. They say that at the time of the crash, Garcia was not under the influence of drugs or alcohol.

| Motorist Killed in Texting While Driving Accident |
| Posted By Law Offices of Gerald L. Marcus |
 |
Texting while driving has claimed the life of yet another motorist, this time a 51-year-old woman from Wisconsin.
According to the Dane County Sheriff’s Office, an 18-wheeler truck was making a lawful turn onto a road when a driver in a passenger vehicle collided with the truck. Investigators were later able to determine that the driver, Kathy A. Endsley, was texting when the accident took place. Endsley suffered severe injuries in the collision, which ultimately proved to be fatal. She died at the scene. The truck driver was uninjured.
This is just another example of a life tragically cut short due to texting while driving. Distracted driving, which includes texting while driving, sadly leads to thousands of deaths every year. In fact, the U.S. Department of Transportation estimates that 6,000 lives were lost in accidents involving distracted drivers in 2008.

| Coal Truck Driver’s Family Files Wrongful Death Suit for $17 Million |
| Posted By Law Offices of Gerald L. Marcus |
 |
The family of a coal truck driver in Tennessee has filed a
wrongful death lawsuit after the victim was killed while driving a company vehicle.
The lawsuit was filed by the widow of Darrell T. Seiber, on behalf of herself and their two minor children. She is seeking $7 million in compensatory damages and $10 million in punitive damages.
Seiber was killed when the coal truck he was driving went off the road, into a ditch, hit a tree, and overturned. Named as the defendant in the lawsuit is National Coal Corp., a company based in Knoxville, Tennessee.
Seiber was driving a truck for Joe Cox Trucking, an independent hauling company that provided trucks for National Coal.
The lawsuit states that an investigation conducted by the U.S. Department of Labor’s Mine and Safety Health Administration found that National Coal violated several regulations, including failure to ensure that independent contract drivers, like Seiber, receive initial mine training, and that an engine brake accelerator switch on the truck was not working at the time of the accident. The investigation also discovered that the truck was overloaded.
At the time of the accident, the truck was carrying as much as 169% of its maximum gross vehicle weight rating, which the administration said was a contributing factor to the accident.

| Speed Believed to be a Factor in Pick-Up Truck Accident. |
| Posted By Law Office of Gerald L. Marcus |
 |
Authorities in Lyon County, Iowa say speed was a likely factor in a pick-up truck accident that left a man injured.
According to a Lyon’s County Sheriff’s deputy, the man was driving along 481
st Street along the South Dakota/Iowa border when for some reason his truck went off the road and crashed into a tree.
The man was taken to a nearby hospital to receive treatment for his injuries. It was not reported what type of injuries the man sustained.
The sheriff’s department is now investigating the cause of the crash.
If you have been injured in a
truck accident in California, you may have grounds to recover compensation under the state’s personal injury laws. The law states that if an accident is caused by another person's negligent or reckless actions, the victims have the right to be compensated for their pain and suffering, medical expenses, lost wages, and property damage. Because speeding is considered a form of negligence, the victim in this case would likely have been held liable for damages had he injured another person.
